Fine Payments

Please be advised the Court Clerks can not accept fine payments over the phone!

All fine payments will be accepted Monday through Friday from 9 am to 4 pm ONLY.

Credit card payments accepted online or 888-912-1541. (A convenience fee will apply.)  If paying online, please click on the field "I want to pay a Traffic Ticket - Non Parking tickets".

If you require a receipt, please include a self-addressed stamped envelope.

Traffic Tickets

Please be advised that Traffic Court is currently being held on a limited basis only. You only to appear if you have received a letter from the Court informing you.

To plead guilty, fill in Section A and mail the ticket(s) to the Court. After we receive your guilty plea you will receive a fine letter in approximately 4 to 6 weeks.

If you wish to plead not guilty, fill in Section B, and mail the ticket(s) to the Court.  The Town Prosecutor will contact you via mail about a possible reduced plea.  This process takes 4- 6 weeks.  You will not have to appear in Court. If your address does not match your license, please contact the court to update.

If you wish to meet with the Town Prosecutor in person to discuss your case, you can reject the Town Prosecutors mail offer and request a court date.

Failed to Answer Traffic Ticket(s)/Suspension

If you fail to respond to your traffic ticket(s), your license will be suspended with the New York State Department of Motor Vehicle and a fee must be paid before the suspension can be lifted.  

To lift a suspension once it occurs there is cost of $70.00 per EACH ticket you received.  

If your license is currently suspended with the Hamburg Town Court, you must contact the Court Clerk to resolve the matter.  BE ADVISED THE CLERK WILL NOT LIFT THE SUSPENSION OVER THE PHONE, YOU MUST APPEAR IN PERSON OR MAIL IN YOUR PLEA. 

Payment of a suspension lift fee WILL NOT resolve your case.  You must resolve the ticket(s) or your license will be suspended again, resulting in further fines.

Criminal Matters

All criminal matters are being scheduled for appearances. If you have recently moved, please contact the court with your new address.

Small Claims / Civil / Evictions

Small Claims, Evictions and Civil filings are accepted at the Court Clerk's Office Tuesday, Thursday, and Friday 9 am to 1 pm only.

Small Claim proceedings may be brought by any individual against anyone who resides or owns a business in the Town of Hamburg. The maximum claim allowed is $3,000.

The filing fee is $10, if the amount you are suing for is $1 up to $1,000 and $15, if the amount is $1,001 up to $3,000.

The filing fee is payable upon filing the application, the Court Clerk cannot accept an application without the filing fee.

Evictions

Eviction filings are accepted Tuesday, Thursday, and Friday from 9:00AM to 1:00PM ONLY.

The Court MAY NOT assist in the execution of the required forms, nor does the court provide the eviction paperwork.

Evictions filed in the Hamburg Town Court will be heard in Erie County's Landlord Tenant HUB Court – Buffalo City Court.  Filing must occur in the local court and not the HUB Court.

Once the forms have been completed, you serve the tenant before you file in Hamburg Town Court, service must be completed at least ten (10) days and not more than seventeen (17) days BEFORE the court date.  Please schedule the court date for Tuesday, Thursday or Friday at 10:00am – (this is a control date).  It must state the tenant needs to appear in the Hamburg Town Court, 6100 South Park Avenue, Hamburg NY 14075. 

After the tenant has been served, the completed paperwork must be filed at the Hamburg Town Court with the $20.00 filing fee.
